Will I Go to Jail for DUI in Overland Park?
All levels of DUI used to carry mandatory jail time in Kansas, with a first time DUI carrying a minimum two day jail sentence. In July of 2022 Kansas DUI Laws changed and the statute no longer requires mandatory jail time for first time DUI offenders. However although not required by law, the Overland Park Prosecutor may still recommend jail time on a first DUI and Judges may still require you to serve jail time on a first time DUI conviction. A second DUI or third DUI in Kansas still carry mandatory jail requirements if you are convicted of DUI.
How Can I Request a DUI Driver License Hearing in Overland Park
Your right to request a Driver License Hearing to determine whether the State of Kansas can suspend or revoke your Kansas Driver License expires after ten business days . If it is alleged that you failed or refused a test of your breath or blood the Officer is required under law to personally serve you with a DC-27 form notifying you of the potential license penalties. This form may be pink in color. The DC-27 form serves as your temporary license in Kansas after being charged with DUI in Kansas and you should carry it with you when driving in Kansas.
The possible suspension or revocation of your Kansas Drivers License is a separate matter from the criminal case in Overland Park Municipal Court. A Driver License Hearing request must be made in writing and must request all certifying officers be present or the officers will not be required to attend the Drivers License Hearing. A hearing request must be made within ten business days.
